Political Asylum:

What is political asylum?

United States provides protection to those who have suffered persecution or
fear of persecution that they will suffer in the future due to race; religion;
nationality; membership in a particular social group; and political opinion.

Who is eligible for political asylum?

According to Immigration and Nationality Act, "Any person who is outside any
country of such person’s nationality or, in the case of a person having no
nationality, is outside any country in which such person habitually resided, and
who is unable or unwilling to avail himself or herself of the protection of that
country because of persecution or a well-founded fear of persecution on
account of race, religion, nationality, membership in a particular social group,
or political opinion."

What are benefits if my asylum application is approved?

Once your asylum application is approved, you are permitted to remain and
work in the United States. You may petition to bring your spouse and
unmarried child(ren) under the age of 21 to the United States. In addition, you
may eligible to apply Permanent Resident Card One year after your asylum

How do I apply political asylum?

To apply for asylum, file a form I-589 with your supporting evidences to USCIS.
You should file the application within one year of your arrival to the United
States. There is no fee to apply for asylum. We highly recommend you to hire
an experienced immigration attorney to help you file asylum application.

How long does it take to get decision for my asylum application?

The average time for asylum applicants to receive a decision from local
asylum office is 4-6 months. If your case is referred to immigration court, it may
take several years to get your final order from an immigration judge.
